Grandparents

The Family Law Act, provides for grandparents to apply for parenting orders in relation to their grandchildren. Depending on the circumstances, grandparents may be seeking orders that their grandchildren live in their primary care, or alternatively, orders that they spend regular time with them.

Issues often arise in circumstances whereby the grandparents have been looking after the grandchildren for a period of time and the parents or one of them decides they want them back in their care but the grandparents may have concerns for the children’s welfare if this were to happen. Issues arise in circumstances whereby a parent or both of them have problems with drugs or alcohol.

Fair Family Law have acted in a number of matters in which grandparents achieved parental responsibility and “live with” orders for their grandchildren and have acted in other matters in which grandparent shave achieved orders for time in school holidays and on weekends.
